(a)   What is delegated legislature?

(b)   Outline five merits of delegated legislation.

Observation

This was another popular question as majority of the candidates attempted it.  Some of the candidates who attempted the question did not do justice to the (a) part.  They wrongly defined it as a process of delegating power to make law and they lost marks.  Rather, delegated legislation is the law made by a body other than legislature.

However, candidates’ performance was better in the (b) part of the question.  They did not have any difficulty in outlining the merits of delegated legislation.  This made the overall candidates’ performance in the question average.

Some of the merits identified by candidates included:

- reduces the work load on the legislature;
-  makes for flexibility;
-  enhances quick decision making;
-  gives room for technical and professional expertise, etc.
