Question 1

(a) Explain delegated legislation.
(b) State four reasons for practising delegated legislation.

Observation

This was the most popular and a straight forward question. All the candidates who attempted it performed very well and scored high marks. Nevertheless, some candidates deprived themselves good marks in part (b) by mere listing the points without further explanation. Candidates were expected to provide the following answers to the question:

(a)       Delegated legislation is the practice by which parliament gives some of its law-     making functions and powers to other bodies and institutions that are subject         to control by parliament.

(b)       (i)         To reduce the workload of the legislature.
(ii)        To take care of technical/expertise matters.
(iii)       It saves time.
(iv)       Allows for laws to be experimented at the local areas.         
(v)        It makes for quick decision-making.
(vi)       It provides mechanism to supplement existing laws.
(vii)      It enhances decentralization.
(viii)     It takes care of emergency situation.
(ix)       It makes for flexibility.
(x)        It enhances thoroughness/efficiency.
