(a) State four rights of a consumer under the Sales of Goods Act.

(b) List and explain four laws enacted by government to protect consumers.

Observation


The question was also avoided by most candidates. Those who attempted the question stated the responsibilities of the seller for the part a of the question. For part b of the question they could not explain the laws.

The expected responses to the question include:

7(a) Rights of the consumer

i. The consumer has the right to safety, that is, purchase of safe products that will satisfy his needs.

ii. He has the right to choose products without any intimidation or interference.

iii.He has the right to seek redress for any form of injustice or denial of privileges/ right to be heard.

iv He has the right to be given value for his money.

v He has the right to be informed about the quality and prices of goods and services as well as their availability.

v. To bring under control the pollution of the lake.

vi He has the right of refund for goods that do not meet the expected performance.


7(b)Laws government enacted to protect consumers

i. Standard Organization Act

The establishment of Standard Organization Act ensures quality control of all products.

ii. Foods and Drugs Act

The law ensures that manufacturers and sellers comply with laid down rules, specifications and provisions of the legislation, regarding the production, importation, exportation and sale of drugs, foods and cosmetics.

iii. Rent Tribunal Act

Establishment of rent tribunals ensure that tenants and land lords live harmoniously without bitterness and exploitation.

iv. Consumer Protection Council Act

It promotes and protects the interests of consumers over all products by eliminating hazardous and sub-standard goods from the market.

v. Price Control Act

It is meant to ensure that consumers are protected from exorbitant prices.

vi. Hire Purchase Act

Its establishment provides redress regarding hire purchase and credit sales agreements in relation to recovery of goods as well as conditions and warranties that may apply to the agreement.

vii. The Trade Description Act

It protects customers from buying goods with misleading labels or descriptions.

viii. Misrepresentation Act

It protects consumers from false or fraudulent claims that induce them to enter into a contract.

ix. Sales of Goods Act

It regulates the rights and duties of buyers and sellers in contracts of sale and provides remedies for breaches.

x. Weights and Measures Act

It regulates the unit of measurement used in trade to protect consumers against exploitation.
