  State five factors that can limit the independence of the judiciary.

Observation

This was a popular question and the candidates who answered it performed very well. They really had a good idea of the question. However, few candidates performed poorly by listing their points. The candidates were expected to write the following points as answers to the question:

 

  1. Executive interference;
  2. Personal interest of the judge;
  3. System of government i.e. military regimes;
  4. Political party: influence;
  5. Crisis of integrity- corruption/bribery;
  6. Mode of appointment/dismissal;
  7. Lack of adequate financial resources;
  8. Poor remuneration for judges and judicial staff;
  9. Social ties;
  10. National/public interest.
