Outline six disadvantages of an unwritten constitution.

Observation

 

This was a straightforward question but poorly attempted by candidates. 
It was evident from candidates’ responses that they had shallow understanding of the demands of the question.  Majority of those that attempted it performed below average.

The major shortcoming of candidates in this question was that they found it difficult to distinguish clearly between written and unwritten constitution.   In order to score good marks in this question, candidates were expected to identify some of the following points:

  • it can be manipulated by the political leaders;
  • it may lead to emergence of dictatorship;
  • it deprives citizens from knowing their rights and duties;
  • lack of codification of fundamental rights of citizens undermines the ability to seek redress when rights are violated;
  • it creates ambiguities which can lead to general misinterpretation;
  • it is not suitable for multi-ethnic/multi racial societies, etc.
