State five factors that can limit the independence of the judiciary.
Observation
This was a popular question and the candidates who answered it performed very well. They really had a good idea of the question. However, few candidates performed poorly by listing their points. The candidates were expected to write the following points as answers to the question:
- Executive interference;
- Personal interest of the judge;
- System of government i.e. military regimes;
- Political party: influence;
- Crisis of integrity- corruption/bribery;
- Mode of appointment/dismissal;
- Lack of adequate financial resources;
- Poor remuneration for judges and judicial staff;
- Social ties;
- National/public interest.
